1 Online Content Policy
1.1 The Eros General Manager is responsible for approving all content prior to it being posted to this website.
1.2 This website does not permit end users to post content to the website.
1.3 End-users must not use this website in breach of community standards set out or described in these Terms of Use.
1.4 This website does not permit end-users to solicit, access, generate, distribute, or store class 1A or class 1B material as defined in the Online Safety (Designated Internet Services – Class 1A and Class 1B Material) Industry Standard 2024. Under the Standard:
- class 1A material means child sexual exploitation material, pro-terror material, or extreme crime and violence material; and
- class 1B material means crime and violence material (other than extreme crime and violence material) or drug-related material.
1.5 This website does not permit end-users to solicit, access, generate, distribute, or store class 1C or class 2 material as defined in the Designated Internet Services Online Safety Code (Class 1C and Class 2 Material) . Under the DIS Code:
High-impact online pornography means class 1C and class 2A material
Class 1C material describes or depicts specific fetish practices or fantasies. It also includes content that has or would be RC Refused Classification under the National Classification Code.
Class 2A material is a subcategory of class 2 material defined for the purposes of the DIS Code as being comprised of material that is a film, the contents of a film, or material that for the purposes of this Code is otherwise to be treated in a corresponding way to the way in which a film would be classified under the Classification Act that:
(a) is classified X 18+ under the Classification Act; or
(b) has not been classified, but if it were to be classified under the Classification Act, it would likely be classified X 18+, because it depicts actual (not simulated) sexual activity between consenting adults.
Note 1: Certain online image-based material is to be treated in the same way as films under the DIS Code. For example, material in the form of user-generated photographs (such as that which may be posted on a social media service) will be treated as if it was a film, and not as a publication.
Note 2: This subcategory will not be applicable to material that is a computer game, as there is no equivalent to the X 18+ classification rating for computer games.
Note 3: This subcategory may include ‘deepfakes’ and other synthetically generated materials to the extent that they depict actual (not simulated) sexual activity.
Other Class 2 material
Class 2B material is a subcategory of class 2 material defined for the purposes of the DIS Code as being comprised of material that:
(a) is class 2 material because it depicts high-impact sexually explicit images (including high-impact nudity); but
(b) excludes class 2A material.
Note 1: This subcategory may include ‘deepfakes’ and other synthetically generated materials to the extent that they depict high-impact sexually explicit material (including high-impact nudity) that is not class 2A material.
Note 2: In this definition, the reference to ‘images’ includes both still images and video images.
Class 2C material means high impact violence and themes of crime and drug and alcohol dependency.
Class 2D material means self-harm material that encourages, promotes or provides instruction for suicide, deliberate self-injury and/or eating disorders.
Class 2E material means simulated gambling material.
Many of the above mentioned terms and definitions in this Online Content Policy, including content classes, have been sourced from the website of the Australian eSafety Commissioner (www.esafety.gov.au) which also has online information to help you manage online safety.
2 The Members’ Section
The Members’ Section of this website contains information about legislation, regulations, guidelines, codes, standards, plans, and the like that are of importance, relevance, or interest to Eros members.
2.1 The Members’ Section of this website is for the use of current Eros members only.
2.2 The Members’ Section is accessible only to members via their unique password.
2.3 Members are provided with a unique password on request after becoming a member of the Association.
2.4 Once a member is provided with their initial password, they are able to log in to the Members’ Section and generate a new password of their choice or update their password.
2.5 Members must keep their Members’ Section password secret and confidential and protect it against wrongful access.
2.6 The information contained in the Members’ Section must not be circulated, provided or copied to any other person, business, organisation, company, or group without the prior written consent of the Eros General Manager.
2.7 The Members’ Section of this website does not permit end-users to solicit, access, generate, distribute, or store class 1 or class 2 material.
3 Other Sites, Content, Products and Services
3.1 Third parties may offer their products and services via this website by agreement with the Eros General Manager.
3.2 Eros is not responsible for products or services provided by third parties via this website and is not responsible for their third parties’ activities nor the content of third parties’ websites.
