It is is crunch time for website providers as compliance with Australia’s Designated Internet Services Online Safety Code (Class 1C and Class 2 Material) falls due on 9 March 2026. Website Risk Assessments, based on content and functionality, must have been conducted and documented, risk levels determined and compliance measures relevant to the level of risk implemented by this date.
Conducting a Risk Assessment of the content, purpose, scale (size) and functionality of your website, documenting the methodology used and documenting the outcomes of your Risk Assessment, and ensuring your website complies with the measures relevant to your Risk Assessment are key steps under the DIS Code.
A key consideration for Australia’s eSafety Commissioner (who oversees compliance) is whether a website provider is taking reasonable and demonstrable steps to comply with the DIS Code.
The Designated Internet Services (DIS) Code is the online safety industry code for websites. It regulates:
- Class 2 Material including legal online content that would be classified as X18+, R18+, Category 1 or Category 2 under the National Classification Code.
- Class 1C Material (illegal sexually explicit online content that would be Refused Classification RC).
